TERMS AND CONDITIONS OF THE ONLINE STORE Webinario.in

I. GENERAL INFORMATION

  1. The online store operating at the Internet address www.webinario.pl is run by OCC Sp. z o. o. with its registered office in Katowice (address: ul. Lubiny 10c, 40-582 Katowice), entered into the Register of Entrepreneurs of the National Court Register, kept by the District Court Katowice-Wschód in Katowice, VIII Commercial Division of the National Court Register, under KRS number 0000370664, NIP 9542713592, REGON 241802158, share capital of PLN 10,000.
  2. These regulations (hereinafter: “Regulations”) apply to the services provided by the Administrator in the form of organizing and conducting online training, offered via the website “https://webinario.in”.
  3. The Regulations specify the types, scope and conditions for the provision of services by the Administrator, the conditions for concluding contracts, the principles of personal data protection and the complaint procedure.
  4. It is not allowed to set up several accounts on the Website by one person, or to share an existing account with other people.
  5. The User undertakes to protect and care for confidential data, such as the password to access the Website.
  6. The User undertakes not to take actions that could destabilize the operation of the Website, or that could in any way hinder the use of the Website by other Users.
  7. You agree not to attempt to access resources to which you are not authorized. It is not allowed to use automated tools that send data to the Administrator’s servers or download data from them.
  8. Placing an order in accordance with these Regulations requires acceptance of these Regulations.

II. DEFINITIONS

  1. The following terms used in the Regulations have the following meaning:
    • Administrator/Seller – OCC Sp. z o. o. with its registered office in Katowice (address: ul. Lubiny 10c, 40-582 Katowice), entered into the Register of Entrepreneurs of the National Court Register, kept by the District Court Katowice-Wschód in Katowice, VIII Commercial Division of the National Court Register, under KRS number 0000370664, NIP 9542713592, REGON 241802158, share capital of PLN 10,000.
    • Online store – online store run by the Seller – OCC Sp. z o.o., available on the website: www.webinario.in
    • Event – organized by the Administrator and conducted by a person indicated by him, an event in the form of a recorded video material.
    • Live event – organized by the Administrator and conducted by a person indicated by him, an event in the form of an on-line webinar. The live event will take place at the date and time specified by the Administrator.
    • Services – events or live events as described in the product cards.
    • User/Client – the buyer of goods/services offered in the Online Store. The client may be a natural person with full legal capacity and a legal person. The customer may be a consumer or a non-consumer entity that is an entrepreneur – within the meaning of the Act of March 6, 2018 Entrepreneurs’ Law (Journal of Laws of 2018, item 646) and purchase these goods in connection with their business activity.

IV. PLACING ORDERS

  1. Information placed on the website of the online store www.webinario.pl does not constitute an offer within the meaning of the Act of 23 April 1964 Civil Code (Journal of Laws of 1964 No. 16 item 93, as amended). This information is an invitation to submit offers by customers. Thus, merely placing an order by the Customer is not sufficient to conclude a Sales Agreement. By completing the order placement procedure, the Customer submits an offer to purchase the Service to the Online Store. The Distance Sales Agreement is concluded when the Customer receives the order confirmation sent by the Online Store in the manner specified in point IV.7 of these Regulations.
  2. The terms of the Sales Agreement are set out in these Regulations, applicable law, including the provisions of the Act of April 23, 1964, the Civil Code (Journal of Laws No. 16, item 93, as amended), the Act of July 18, 2002 on the provision of electronic services (Journal U. 2002, No. 144, item 1204, as amended), any individual arrangements made by the Customer with the Online Store in connection with placing an order, and in relation to consumers, also the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws of June 24, 2014, item 827).
  3. Orders can be placed 24 hours a day throughout the year via the Online Store. Orders paid by online payments are processed immediately.
  4. In order to view the offer available in the Online Store, the Customer must go to www.webnario.pl. After entering the Online Store, the Customer will be able to select any Event available in the Online Store. The customer makes a choice by selecting the selected Event and fills in the order form. After making a decision to purchase the selected product, you must confirm the execution of the order.
  5. In order to place an order via the Online Store, it is required to provide the Customer’s data using the order form.
  6. Orders about which there are any doubts will be verified by the staff of the Online Store. The customer will be informed about the ongoing verification of his order by phone or via e-mail. If the Customer does not confirm the content of the placed order, the order will be canceled by the Online Store.
  7. Acceptance and commencement of execution by the Online Store of each placed order is confirmed by sending the Customer a confirmation in the form of a letter to the e-mail address indicated by the Customer in the order form.
  8. By placing an order, the Customer confirms by ticking the appropriate box on the Online Store website that he has read the Regulations of the Online Store and accepts its provisions.
  9. The seller running the Online Store issues a sales document, which is a invoice.

V. ORDER FULFILLMENT

  1. Access to the Events is provided immediately after the payment for the order is credited. All information and links to paid Events can be found in the My Account tab on the website www.webinario.in
  2. Access to Live Events – The User ordering access to the live event will receive a special link by e-mail with a token that will allow access to the live event on the platform indicated by the Administrator.
  3. The Administrator reserves the right to change the date of the Live Event, of which he will inform the User at least 3 days before the start date of the Event. The User may then carry out the Events on the newly set date or resign from the Event, obtaining a refund of the amount paid, provided that the Administrator is informed about the resignation in writing or via e-mail no later than 24 hours from the moment of receiving information about the change of the Event date.
  4. In the event of cancellation of the Live Event by the Administrator, the Administrator will refund the User the amount paid in full or propose to conduct the Live Event at a different time. The cancellation of the Live Event or its rescheduling by the Administrator will take place in the form of an e-mail sent to the address indicated by the User.

VI. FORMS OF PAYMENT

  1. Customers can use the following online payment methods:
    • payment by credit card
    • payment by imoje
  2. Payments for products purchased in the online store are made using the prepayment system. Therefore, the split payment mechanism cannot be used because you have not received an invoice for the purchased products.

VII. PRICES AND DELIVERY COSTS

  1. All prices are in US dollars (USD) and are gross prices.
  2. The given prices are binding at the time of placing the order by the Customer.
  3. The Seller reserves the right to change the prices of available Services and to conduct and cancel all types of promotional campaigns, provided that price changes do not apply to orders already placed by the Customer.

VIII. PERSONAL DATA PROTECTION, COOKIES AND NEWSLETTER

  1. The administrator of personal data is OCC Sp. z o. o. with its registered office in Katowice at ul. Lubiny 10c.
  2. Contact regarding personal data is possible via the e-mail address: biuro@webinario.in.
  3. Depending on the selected services or functionalities on the website www.webinario.in, personal data will be processed for the following purposes:
    1. execution of the order in the store located at webinario.pl pursuant to art. 6 sec. 1 point b),
    2. creating and administering an account in the webinario.pl store pursuant to art. 6 sec. 1 point a),
    3. marketing by sending a newsletter pursuant to art. 6 sec. 1 point a),
    4. in order to conduct correspondence via e-mail or the contact form at www.webinario.pl pursuant to art. 6 sec. 1 point b) (activities necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject before concluding the contract) or art. 6. section 1 point f) (pursuing possible claims) and, if additional consents are given – pursuant to art. 6 sec. 1 lit. a RODO – to the extent and for the purposes indicated in the content of these consents.
  4. Depending on what data we process, the recipients of personal data may be entities providing services:
    1. Hosting – applies to data processed for the purpose of order fulfillment, account administration in the webinario.in store, electronic correspondence.
    2. IT – concerns data processed for the purpose of administering accounts in the webinario.pl store, as well as data necessary to participate in live events.
    3. Sending the newsletter – applies to data processed for the purpose of sending the newsletter.
    4. Accounting and bookkeeping – applies to data processed in order to fulfill orders in the webinario.in store.
  5. Personal data will not be transferred to third countries.
  6. Data storage:
    1. Personal data regarding the execution of orders will be stored for the period required by current tax law.
    2. Data regarding the account in the webinario.in store stored for the period required by tax law from the moment the user requests to delete the account.
    3. Data regarding sending the newsletter will be deleted after canceling the subscription.
    4. Data regarding correspondence will be stored for a period of 5 years (e-mail) or for the period needed to establish and defend claims.
  7. The customer has the right to access their data and the right to rectify, delete, limit processing, the right to transfer data, the right to raise objections, the right to withdraw consent at any time without affecting the lawfulness of processing which was made on the basis of consent before its withdrawal .
  8. The customer has the right to lodge a complaint with PUODO when he considers that the processing of his personal data violates the provisions of the general regulation on the protection of personal data of 27 April 2016.
  9. Providing personal data by the Customer is voluntary, but required to use individual services or functionalities offered by the Administrator.
  10. Customer subscribing to the newsletter:
    1. I agree to receive commercial information by electronic means to the indicated e-mail address within the meaning of art. 10 sec. 1 of the Act of July 18, 2002 on the provision of electronic services from the Administrator.
    2. I consent to the processing of data for marketing purposes by the Administrator.
    3. I agree to the use of e-mail communication for marketing purposes in accordance with the Act of July 16, 2004 Telecommunications Law by the Administrator.
    4. The above consents are granted by clicking on the activation link in the message confirming the subscription to the newsletter, which the Customer receives.

IX. RIGHT TO WITHDRAW FROM THE CONTRACT

  1. The right to withdraw from the Agreement by the Customer is excluded in the case of contracts for the supply of digital content that are not recorded on a tangible medium, if the performance of the service began with the Consumer’s express consent before the deadline for withdrawal from the contract expires and after the Entrepreneur informs him about the loss of the right. withdrawal from the contract. This means that due to the nature of digital media, once a Product has been purchased and downloaded, it cannot be returned. Additionally, payment for the purchase of the Product will not be refunded.
  2. The customer agrees to the delivery of digital content immediately after the payment is recorded, i.e. before the expiry of 14 days from the conclusion of the contract, and thus declares that he has been informed that he is not entitled to withdraw from the contract.
  3. If you purchase a Service with temporary access to content, resignation from membership (access) before the expiry of the period for which the membership was paid does not result in a refund of the payment.
  4. In the case of Live Events, the user has the right to withdraw from the contract a maximum of 24 hours before the start of the Live Event.

X. COMPLAINTS PROCEDURE

  1. The User may submit a complaint in connection with non-performance or improper performance of the services covered by the Agreement, as well as the provision of services electronically by the Service Provider via: a message sent via the contact form, a letter sent by traditional mail to the following address: OCC Sp. z o.o., ul. Lubiny 10c, 40-582 Katowice.
  2. A response to the complaint will be provided as soon as possible, not exceeding 30 days from the receipt of the notification by the Service Provider.
  3. The User will receive information about the processing of the complaint via e-mail or another communication channel chosen by the User when submitting the complaint.

XI. COPYRIGHT

  1. All materials and authorial resources published on www.webinario.pl are the exclusive property of the Authors. They are covered by copyright within the meaning of the Act on Copyright and Related Rights (Journal of Laws of 1994, No. 24, item 83, as amended). Copying and distributing materials and resources is prohibited.

XII. FINAL PROVISIONS

  1. The Seller reserves the right to change the content of the Regulations. The amended Regulations will be published on the Online Store Website and will come into force after 7 (seven) days from the date of publication. These changes do not violate the rights of customers resulting from orders placed before their introduction.
  2. In matters not regulated in these Regulations, generally applicable provisions of law shall apply, in particular the provisions of the Act of April 23, 1964, the Civil Code (Journal of Laws No. 16, item 93, as amended), the Act of July 18, 2002 on the provision of services by means of electronically (Journal of Laws of 2002, No. 144, item 1204, as amended), and in relation to consumers, also the provisions of the Act of May 30, 2014 on consumer rights (Journal of Laws of June 24, 2014, item 827) and the Act of July 27, 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended).
  3. The parties will try to resolve any disputes that may arise in connection with the execution of the order placed by the Customer. If the parties fail to reach an agreement, each party may submit the dispute to a competent common court for resolution.
  4. The consumer may obtain free assistance regarding his rights and in the dispute between him and the Company, among others, by contacting the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, the Association Polish consumers). Information for consumers, including information on the possibilities of obtaining assistance, is also available on the website of the President of the Office of Competition and Consumer Protection www.uokik.gov.pl
  5. Customers who are consumers may use out-of-court methods of dealing with complaints and redress, including via the ODR platform, in accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online consumer dispute resolution. and amendments to Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes).
